A firefighter with an EMT license was pulled over for weaving on Pacific Coast Highway by the Huntington Beach Police Department on a DUI saturation patrol assignment. We won the DMV hearing based upon a violation of California’s Breath Testing requirements, Title 17. Breath testing showed a .097% alcohol level, and the Orange County DA’s office prosecuted this case out of the West Justice Center in Westminster. After pointing out problems with the officer’s version of the events, this DUI case was fully dismissed on October 17th, 2020, preventing a conviction on this first responder’s criminal record, or driving record, saving his career.
