Your arraignment will be at 7:30 a.m. sharp, and there will be paperwork to fill out, unless you have a DUI Defense Lawyer, who will handle both appearing, and all paperwork, for you.

All DUI cases are handled by the Riverside County District Attorneys’ office, who serves as prosecutor for DUI cases in the county.  Murrieta District Attorneys handle felony and misdemeanor DUI cases and always want jail time on a DUI case.  The “standard offer” is 10 days jail, which they will allow you to serve by doing the county labor program.  If you ask for an offer from the judge at arraignment only, the judge will give you five days of county labor.  This strategy is to make the offer from the judge seem more attractive, and as incentive for you to plead guilty at the first court appearance, and not fight the case further.

DA’s in Murrieta are usually very aggressive involving aggravating circumstances; if there is an accident, a high blood alcohol level alleged, DUI while speeding, priors, a probation violation, or a child or minor in the car, then the jail time offer goes up substantially.

Murrieta DUI Lawyer Strategies

We have found, over handling DUI cases for several decades in this court, that the best strategy is to reject the arraignment offer, and to set the case for a motion to suppress evidence, or dismiss (where sufficient grounds lie), or set the case for trial.  With the limited trial resources in this building, that usually, although not always, results in an offer far below what is offered at the arraignment, based upon the strength or weakness of the facts of the case, based upon the strengths or weaknesses of the legal defenses of the case, and based upon our williness to fight the case through trial.
